A Cook County judge on Thursday ordered a 19-year-old man charged with firing shots that killed a 7-year-old boy at his West Side home, who was held without bail shortly after prosecutors dropped murder charges against a second young man related to the death had withdrawn .

Joseph Serrano, 19, of the West Garfield Park neighborhood, is charged with first-degree murder in the October 26 murder of Akeem Briscoe, who authorities said was an accidental victim. A 16-year-old boy was charged with first-degree murder as a minor on Monday, police said.

Cook County prosecutors say Akeem was shot in the abdomen around 8:15 p.m. as he brushed his teeth before going to bed at his home in the 2600 block of West Potomac Avenue.

According to prosecutors, Serrano and the other two, including a minor, were targeted by a vehicle parked behind Akeem’s mansion containing four people. Those individuals were believed responsible for an earlier shooting involving a member of the Campbell Boys gang, with the new shooting serving as retaliation, assistant state attorney Michael Pekara told the court.

Serrano and one of his accomplices reportedly fired a total of 16 shots from separate .40-caliber handguns in the direction of the vehicle, but missed the occupants, Pekara said. One of the targets returned fire.

One of the bullets entered Akeem’s home through a window and struck him in the back, authorities said.

Video footage shows the three suspects traveling to the scene of the shooting and then fleeing, authorities said. A liquor store camera captured the perpetrators’ faces before the shooting, Pekara said.

Serrano, was a high school student who worked part-time and helped raise six siblings after his mother’s death from cancer last year, according to his private attorney John McNamara. The lawyer asked the judge to deny the prosecution’s request, pointing out that no one had identified Serrano as the shooter and that the case was largely circumstantial.

Near the end of the 25-minute hearing, Judge Barbara Lynette Dawkins noted the “exhaustive” investigation by law enforcement officials, using multiple surveillance camera footage to track down the suspects and social media recordings received via a court order to approval of the state’s request to deny bail. She also spoke of the authorities’ “extensive circumstantial evidence” against Serrano.

Prior to Serrano’s hearing, prosecutors dropped the murder charges against an 18-year-old man related to the same shooting without explanation. Court records showed misdemeanor charges were approved by Chicago police chief of detectives Brendan Deenihan. In rare instances, police officers have filed felony charges against an accused without approval from the state’s prosecutor’s felony review unit.

A spokeswoman for the Chicago Police Department declined to comment on the dropped charges and referred to the Cook County Attorney’s office. A representative of the public prosecutor was not immediately available.

Serrano will appear in court next Friday.
